The New Fine for Stunt Driving 30-day Suspension

You were just charged with Stunt Driving or Racing in Ontario, you got an automatic 30-day suspension at the roadside.  After the 30-days you should visit a Service Ontario, and you will be able to start driving immediately from that day up until the end of your case without worrying about any further repercussions from the Stunt Driving charge.

But something has changed.  There is a new fine that is almost impossible to find, and no one is talking about it.

Getting your license back after the 30-day suspension

Up until recently, when you get your license back after the 30-days, there was no fee.  There was no reinstatement fee, as the suspension was administrative and just “ends” after 30 days.  The normal $281+ only applied to licenses that were suspended for other charges and unpaid fines.

Until now….

The new AMP charge

AMP stands for “Administrative Monetary Penalties for High Risk Driving Suspensions”.  

If you try to research the AMP penalty, as of today, Aug 17, 2022, all records point to the fact that is is still a proposal, and not in effect.  AMP is defined by the proposal as:

High risk driving behaviour, like driving while suspended or street racing, puts lives at risk. It is a serious trend that we are continually working to address. That is why the ministry is proposing that drivers who have their licences suspended for certain high-risk driving behaviours should pay administrative monetary penalties.

Drivers who receive suspensions for breaking these identified laws will be required to pay escalating penalties of $250, $350, and $450 for first, second, and third or subsequent suspensions within a five-year period

This means that there is now a possible $250 fee for getting back your license after the 30-day suspension.

The AMP is not fully implemented

Our research has led us to believe that this is either a slow implementation or only being adopted currently on a municipal basis. This means that each municipality is starting to implement this fine, and you may get this charge, or you may not, depending on where you were charged or where you get your license back.  We are unsure as of now.

So what can I expect after my 30-day suspension

You should expect to pay a minimum $250 fine to get your license back.  However, you may pay nothing.  But do not be surprised, as some of our clients have been.  The laws are constantly getting tougher and fines are increasing.

What is the AMP charge for high risk driving suspensions in Ontario?

The AMP (Administrative Monetary Penalties) charge is a proposed fine for drivers who have their license suspended for high-risk driving behaviours like street racing or driving while suspended. The proposed penalties are $250 for the first suspension, $350 for the second, and $450 for third or subsequent suspensions within a 5-year period. Currently, the AMP is not fully implemented and may only be in effect on a municipal basis.

Is there a fee to get my license back after a 30-day suspension for stunt driving in Ontario?

Previously, there was no fee to get your license back after a 30-day suspension for stunt driving in Ontario. However, with the proposed AMP charge, drivers may now be required to pay a minimum of $250 to get their license back. Implementation of the AMP may vary by municipality.
