DUI Impound in Ontario – How Much Does It Cost?

Here are 4 things you need to know.

1/  Who sets the fees?

  • The fees are NOT set by the government. 
  • The fees are NOT set by the Police. 
  • The fees are set by each towing company. 
  • And, these fees are different depending on which company has towed and impounded your vehicle.

2/  What are the fees?

  • While the fees are not the same with all towing companies, the costs are similar.
  • And, generally, the fees fall into 3 buckets.
  • First is the tow fee.  That is the cost to tow your vehicle from where the Police stopped you to the tow yard.  That’s usually in the $150 range.
  • Second is the extra kilometre fee.  If the distance to the tow yard is excessive, sometimes a tow company will charge an extra fee per kilometre.
  • Third is the storage fee.  This is the cost to store your vehicle.  It’s charged per-day and is usually in the $50 to $100 per day range.

3/  Can you get a refund if you win your case?

  • No.  Even if you win your case, you cannot get a refund on the impound fees.
  • You have no legal right against the tow company.
  • Unfortunately, those impound costs are gone.

4/  What happens if you don’t pay the impound fees?

  • You will not get your vehicle back.  This is true even if you have a release order for your car.
  • The total fees you owe will be a debt that you owe to the tow company.
  • And, the tow company has the right to collect that debt using laws under the Repair and Storage Liens Act in Ontario.
