  • In this article, I will tell you 5 key things you need to know IF YOU DO go to jail for driving on a suspended license.

1/ You may be able to serve jail time on weekends

  • The advantage of serving jail time on weekends is that it won’t interfere with any commitments you have during the week.
  • Typically these are job commitments where you need to be working Monday to Friday.  
  • The main disadvantage of serving on weekends is that it may take longer to complete your sentence if that penalty is broken up over multiple weekends.

2/ Weekends are possible only if your jail sentence is less than 90 days

  • If the Justice of the Peace decides that your jail sentence is more than 90 days, you will not be able to serve weekends. You will have to serve straight jail time. 
  • So, this 90-day threshold is critical in how you serve your jail time.

3/ You may be able to pick your starting date for your sentence

  • Generally, the courts are sympathetic to work and family commitments, so it may be possible to choose a date when your jail penalty will start.
  • So, it would be best if you planned appropriately when the timing would work with your schedule.

4/ This person is the final decision maker on your jail penalty.

  • That is the Justice of the Peace.
  • They will decide on whether you will go to jail. 
  • And will also decide on the jail terms.
  • In other words, they will decide on how long your jail sentence will be whether you can serve on weekends. And the specific start dates and times of your jail penalty.

5/ Don’t do this (or you’ll be in big trouble).

  • That is, don’t miss the date and time of your jail sentence.
  • If you’re facing jail as a penalty and are given a date and time to start your sentence, you must show up on that date and time.
  • Do not miss the date. Do not be late.
  • If you miss these dates or times, you’ll face serious consequences, including a criminal charge, and the original terms of the penalty will likely change.
