  • So when you’ve been charged with driving while your licence is suspended in Ontario, you face serious penalties that include fines, a mandatory 6-month driving ban, and potentially jail time.
  • Now, the way the law is written, it is really easy to convict someone in Ontario of this driving while your licence is suspended charge.
  • And on conviction, you will be facing a minimum $1,000 fine.
  • That $1,000 minimum fine is written in the law.  
  • In other words, the court has to give you that $1,000 fine.
  • And, if you are a repeat offender, the law dictates that your fine will increase up to $5,000.
  • For most people, that is a lot of money.
  • However, most people don’t know that even though $1,000 is the minimum fine written in the law, there is a way to potentially overrule that law and get a lower fine.
  • And lawyers know this secret and will use it when it’s appropriate.
  • Here’s how the method works.
  • Under Section 59(1) of the Provincial Offence Act of Ontario, the Justice of the Peace has the power to give someone relief against the minimum fine which is stated in the law.
  • And the Justice of the Peace decides whether the defendant’s situation meets something called “exceptional circumstances,” which, if the minimum fine is given, would be either “unduly oppressive” or otherwise not in the interest of justice.
  • Now, you need to tell your story to the Justice of the Peace and explain how that minimum fine would be oppressive to your situation.
  • Make eye contact with the Justice of the Peace, and tell the truth.
  • If your situation is compelling and one that the minimum fine would really be oppressive to you, then the Justice of the Peace may reduce the fine.
