- First, your driver’s license cannot be suspended for unpaid parking tickets.
- However, the Ministry of Transportation of Ontario, known as the MTO – will not allow you to renew your driver’s license until you pay for those unpaid parking tickets.
- And the second thing you need to know, has to do with notification of your driver’s license suspension.
- We have a lot of clients who’ve been charged with driving while under suspension.
- Most of these clients tell us they did not know their license was suspended because they did not get notice of the suspension.
- These clients then ask us to fight the charge because they did not know their license was suspended. Because if they knew their license was suspended, they would not drive.
- Unfortunately, not getting notice of your suspension is not a legal defence.
- While you are supposed to get notice of your suspension from the MTO, many people do not get the notice.
- Maybe you moved. Or, didn’t get your mail. Or, someone picked up the notice and didn’t give it to you.
- Unfortunately, it does NOT matter whether you GOT the notice.
- To convict you of a driving while under suspension charge, the Prosecutor ONLY needs to prove that the notice of the suspension was generated from the MTO database.
- Yes, this is frustrating. And, people are angry. There have been some media reports about this issue of notice. Changes may be coming, but they are not yet the law.
- Bottom line. If you get tickets, you need to pay them on time. Do not expect the government to remind you to pay.
