1/ Can you get out of the 6-month driving suspension?

  • No. You cannot get out of the 6-month driving suspension.  
  • The 6-month driving suspension is written in the law.  And it’s written in a way that requires the 6-month driving suspension to happen. And that’s why you cannot negotiate your way out of it. 

2/ When does the 6-month driving suspension start?

  • The 6-month driving suspension starts on the date of your conviction.  
  • For example, if you are convicted on January 1, your driving suspension starts on January 1 and would end 6 months later, on July 1.

3/ When the 6-month suspension is over, do you automatically get your driver’s license back?

  • No. At the end of the 6-month driving suspension, you’re able to get your license back. But it’s not automatic.
  • You need to get your driver’s license reinstated. That means you need to contact the Ministry of Transportation of Ontario and pay the license reinstatement fee to get a valid license.

4/ Can you delay the start of the 6-month driving suspension?

  • Maybe. Your 6-month driving suspension will start on conviction. So, the only way to delay the start date is to delay the date of your conviction.
  • Ask the prosecutor for a delay. If driving is a necessary part of your life – whether for personal or work reasons — then you need to make a plan for what you’re going to do during the 6-month driving suspension.  
  • Planning usually takes time. So ask the prosecutor if it’s possible to time your conviction date with your planning schedule.

5/ If your driver’s license is already suspended, can you wait out the 6-month suspension?

  • No. Your 6-month driving suspension will start on the date of your conviction and when your license is valid.
  • For example, if you’re convicted on January 1, your license suspension will start on January 1 and end on July 1. However, if your license is already suspended on January 1 and you only get it back on March 1, your 6-month suspension will start on March 1 and end 6-months later on September 1.

6/ If you get convicted on two driving while suspended charges, are you going to be suspended for 6 months or 1 year?

  • 1-year. The law is clear. For each conviction, you will face a 6-month driving suspension.  
  • If you’re convicted of 2 driving while suspended charges, your driver’s license will be suspended two times 6-months which is 1-year.
